By engaging the services of KimWebDesign.com (“Company,” “We,” “Us,” or “Our”), you (“Client”) agree to be legally bound by the following Terms and Conditions. These terms apply to all services provided, including but not limited to Web Design, SEO, and Website Management.

1. Agreement to Terms

By submitting payment for any service, the Client confirms that they have read, understood, and agreed to these Terms and Conditions. Payment constitutes a legally binding agreement between the Client and KimWebDesign.com.

2. Services

KimWebDesign.com provides digital services including Web Design, Search Engine Optimization (SEO), and Website Management. Specific deliverables, timelines, and pricing may be outlined in an invoice, proposal, or written agreement.

3. Payments

Web Design services require full payment in advance prior to project commencement.
SEO services are billed monthly in advance and may be canceled in accordance with the Cancellation Policy outlined below.
Website Management services are billed monthly or annually depending on the selected plan and may be canceled in accordance with the Cancellation Policy.

Accepted payment methods include credit card, debit card, PayPal, and bank transfer. All payments must be completed in full before services are rendered unless otherwise agreed in writing.

4. No Refund Policy

All payments made to KimWebDesign.com are final, non-refundable, and non-reversible.

By purchasing any service, the Client acknowledges that all services are custom, digital, and time-based, involving intellectual labor that cannot be returned, undone, or resold.

A project is considered commenced immediately upon any of the following:

• Payment has been successfully processed
• Project has been scheduled or reserved
• Initial work has begun, including but not limited to research, planning, setup, design, development, or related communication

Once a project has commenced, no refunds will be issued under any circumstances, including but not limited to change of mind, dissatisfaction after work has begun, delays caused by the Client, or business or financial circumstances.

The Client agrees that services rendered are intangible digital services and are not eligible for return or refund. Any attempt to reverse payment, including chargebacks or disputes without prior communication, constitutes a breach of this agreement.

In the event of a dispute, KimWebDesign.com reserves the right to present documented evidence of work performed, including communications, drafts, files, access logs, timestamps, and task records.

5. Cancellation Policy

Cancellation requests must be submitted in writing.

For Web Design services:
Once payment has been made and the project has commenced, cancellation does not entitle the Client to any refund. If the Client chooses to cancel after work has started, all payments made remain non-refundable and the project will be considered terminated.

For SEO services:
SEO services operate on a recurring billing cycle. The Client may cancel ongoing SEO services by providing at least seven (7) days’ written notice prior to the next billing date. Failure to provide sufficient notice will result in the next billing cycle being charged in full. No partial refunds will be issued for any active billing period.

For Website Management services:
Website Management plans may be canceled with at least seven (7) days’ written notice prior to the next billing cycle. No refunds or prorated amounts will be provided for unused time within the current billing period. Services will remain active until the end of the paid term.

KimWebDesign.com reserves the right to cancel or suspend services due to non-payment, breach of terms, or misuse of services. In such cases, no refunds will be issued.

6. Scope of Work

All services are provided based on the agreed scope outlined in the proposal, invoice, or written communication. Any additional work requested beyond the agreed scope will be subject to additional fees and may require a separate agreement.

7. Revisions

Web Design packages include a limited number of revisions as specified in the service agreement. Additional revisions or changes beyond the agreed scope will be billed at the Company’s standard rates.

8. Client Responsibilities

The Client agrees to provide all necessary content, materials, and access required to complete the project, including but not limited to text, images, login credentials, and approvals.

The Client agrees to respond to communications and feedback requests in a timely manner. Delays caused by the Client may result in adjusted timelines without liability to KimWebDesign.com.

9. Project Timelines

Estimated timelines will be provided at the start of the project. All timelines are dependent on Client cooperation and timely delivery of required materials. Delays caused by the Client will result in revised delivery schedules.

10. Delays and Abandonment

If the Client becomes unresponsive for a period of fourteen (14) days or more, the project may be considered inactive or abandoned.

No refunds will be issued for abandoned projects. Reactivation of the project may require additional fees and scheduling adjustments.

11. Ownership and Rights

Full ownership of the final deliverables will be transferred to the Client only after full payment has been received.

KimWebDesign.com retains the right to display completed work in its portfolio, marketing materials, and case studies unless otherwise agreed in writing.

12. Hosting, Domains, and Email

Hosting, domain, and email services may be included in certain packages for a specified term. Renewal fees will apply after the initial term. Failure to renew may result in suspension or termination of services.

13. Website Management

Website Management services include routine maintenance such as updates, backups, monitoring, and basic support. Requests outside the scope of maintenance, including design changes or feature enhancements, may incur additional charges.

14. SEO Services

SEO services are provided based on industry best practices; however, no guarantees are made regarding search engine rankings or specific performance outcomes.

SEO services require Client cooperation, including access to analytics platforms and content approvals. Cancellation is subject to the terms outlined in the Cancellation Policy.

15. Chargebacks and Disputes

The Client agrees not to initiate any chargeback or payment dispute without first attempting to resolve the matter directly with KimWebDesign.com.

Initiating a chargeback or dispute after services have commenced constitutes a breach of this agreement. KimWebDesign.com reserves the right to present all evidence of work performed and to pursue recovery of funds and associated fees.

16. Termination

KimWebDesign.com reserves the right to terminate any project or service at its discretion in cases including but not limited to non-payment, lack of communication, or abusive conduct. No refunds will be issued for terminated services.

17. Limitation of Liability

KimWebDesign.com shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of revenue, business interruption, data loss, or third-party service failures.

Liability is limited to the total amount paid by the Client for the service.

18. Indemnification

The Client agrees to indemnify and hold harmless KimWebDesign.com from any claims, damages, or liabilities arising from the Client’s use of services, content provided, or business activities.

19. Governing Law

These Terms and Conditions shall be governed and interpreted in accordance with the applicable laws of the jurisdiction in which the Company operates.

20. Acceptance

By submitting payment and engaging services, the Client acknowledges and agrees to all terms stated above.
