Terms and Conditions

By choosing to engage the services of KimWebDesign.com (referred to as “We,” “Us,” or “Our”), you (the “Client”) agree to the following Terms and Conditions. These terms apply to all services provided, including Web Design, SEO, and Website Management.

1. Service Agreement

Upon selecting and paying for any of our services (Web Design, SEO, or Website Management), you agree to the scope, pricing, and terms outlined herein. A formal invoice and/or proposal may accompany specific service packages for reference.

2. Payments

  • Web Design: Full payment is required upfront before the project begins.
  • SEO Services: Billed monthly in advance. You may cancel anytime with 7 days’ notice before the next billing cycle.
  • Website Management: Billed monthly or annually, depending on the chosen plan.

Accepted payment methods include credit/debit card, PayPal, or bank transfer.

3. No Refund Policy

All payments are non-refundable once services have commenced. This applies to all offerings, including website design, SEO, and management services. This policy helps allocate resources and manage project timelines efficiently.

4. Project Scope & Revisions

Each package clearly outlines what is included:

  • Web Design: Includes the number of pages, hosting, emails, and features as listed.
  • SEO Plans: Includes keyword limits, content output, and deliverables as per the plan selected.
  • Website Management: Covers general updates, backups, security checks, and performance monitoring.

One round of revision is included in Web Design packages. Additional revisions or requests beyond the agreed scope will incur extra fees, quoted beforehand.

5. Client Responsibilities

To ensure timely delivery and effective collaboration, the Client agrees to:

  • Provide website content (text, images, logo, etc.)
  • Grant necessary access to domains, hosting, or CMS
  • Respond to feedback and revision requests promptly

Delays in content submission or approvals may impact delivery timelines, for which KimWebDesign.com is not liable.

6. Project Timelines

Estimated timelines will be discussed and agreed upon at the start of the project. Timelines are dependent on Client cooperation. Delays caused by Client inaction, incomplete submissions, or prolonged feedback will result in adjusted delivery dates.

7. Ownership & Portfolio Rights

Upon final payment:

  • The Client owns the completed website and its content.
  • KimWebDesign.com retains the right to display completed projects in its portfolio and marketing materials.

For SEO content (e.g., blogs, metadata, citations), the content becomes the Client’s upon successful payment.

8. Website Hosting, Domain, and Email

Web design packages may include 1 year of free hosting, SSL, and email setup. After the initial term, renewal fees apply. Failure to renew may result in service interruption or website takedown.

9. Website Management & Support

  • Website management plans cover routine updates, backups, uptime monitoring, and technical support.
  • Support requests beyond maintenance scope (e.g., design changes or feature additions) may incur separate charges at our standard hourly rate.
  • Emergency support is available for an additional fee, if not covered under the plan.

10. SEO Service Terms

  • SEO is an ongoing strategy, and while we implement best practices, we do not guarantee specific rankings due to the nature of search engine algorithms.
  • Cancellation requires 7 days’ notice before your next billing date.
  • Client must provide access to Google Analytics, Search Console, and CMS if required.
  • SEO work (including content, backlinks, and citations) is tailored to the agreed keyword strategy and cannot be arbitrarily reassigned.

11. Termination of Service

We reserve the right to terminate a project or ongoing service if:

  • The Client is unresponsive for 30 days or more
  • Payments are delayed beyond 15 days after the due date
  • Communication is abusive or unprofessional

12. Liability

KimWebDesign.com is not liable for:

  • Losses due to downtime, hacking, malware, or third-party service failure
  • SEO performance beyond the agreed deliverables
  • Legal or compliance issues related to website content supplied by the Client

13. Acceptance of Terms

By submitting payment or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
